North Shore Tutors Terms and Conditions

Please read these Terms and Conditions before using North Shore Tutors.

These Terms apply to tutoring and related services provided or arranged by North Shore Tutors Pty Ltd ("North Shore Tutors", "NST", "we", "us" or "our").

By:

  • accepting these Terms;

  • submitting an enquiry

  • booking a tutoring session;

  • permitting a student to attend a tutoring session; or

  • continuing to use our tutoring services after being provided with these Terms,

you agree to be bound by them.

If you are accepting these Terms on behalf of a student under 18 years of age, you confirm that you are authorised to do so.

1. Our services

North Shore Tutors provides and arranges educational tutoring and associated services.

Services may include:

  • one-to-one tutoring;

  • online tutoring;

  • in-person tutoring;

  • tutor matching;

  • educational resources;

  • lesson preparation;

  • student progress reporting;

  • educational support; and

  • related administrative services.

Tutoring may take place:

  • at a client's home;

  • at a tutor's agreed location;

  • in a library or other public location;

  • online; or

  • at another location agreed between the parties.

2. Tutor matching

We seek to match students with tutors based on factors such as:

  • subject;

  • year level;

  • academic needs;

  • learning goals;

  • location;

  • availability;

  • tutor experience;

  • tutor expertise;

  • learning preferences; and

  • other information provided to us.

While we make reasonable efforts to recommend an appropriate tutor, we cannot guarantee that every tutor will be the ideal personal or educational fit for every student.

Clients are encouraged to provide accurate information about the student's needs and preferences so that we can make an informed match.

3. Tutor information

We may provide a tutor biography or profile containing information such as:

  • academic results;

  • qualifications;

  • university studies;

  • tutoring experience;

  • subject expertise; and

  • relevant experience.

Tutor profiles are intended to assist families in considering a tutor.

They should not be interpreted as a guarantee of a particular academic outcome.

4. First Lesson Guarantee

We want families to be confident in their tutor match.

If you are not satisfied with your first tutoring session with a newly matched tutor, you must notify North Shore Tutors within 48 hours after the session.

If the First Lesson Guarantee applies, you will not be charged for that first session.

The guarantee:

  • is intended to allow a genuine assessment of tutor suitability;

  • must be requested within 48 hours;

  • applies to the first session with the relevant newly matched tutor unless we agree otherwise;

  • does not apply to repeated sessions after the client has chosen to continue with that tutor; and

  • may not be used where the session did not proceed substantially because of the client's or student's conduct, absence or technical issue for which North Shore Tutors or the tutor was not responsible.

This guarantee is provided in addition to any rights you may have under the Australian Consumer Law and does not limit those rights.

5. No lock-in contract

Unless we expressly agree otherwise in writing, North Shore Tutors does not require clients to enter into a fixed-term tutoring commitment.

You may:

  • stop tutoring;

  • change tutors; or

  • change the frequency of tutoring

subject to these Terms, including the cancellation policy for sessions that have already been scheduled.

6. Scheduling sessions

Tutoring times may be arranged through:

  • North Shore Tutors;

  • TutorCruncher;

  • the tutor; or

  • another method approved by North Shore Tutors.

Clients and tutors may agree on recurring lesson times.

A recurring schedule does not prevent either party from changing future sessions in accordance with the cancellation requirements below.

7. Cancellation and rescheduling

7.1 More than 24 hours' notice

You may cancel or reschedule a tutoring session without a cancellation charge by providing at least 24 hours' notice before the scheduled starting time.

7.2 Less than 24 hours' notice

If less than 24 hours' notice is provided, the full session fee may be payable.

This reflects that:

  • the tutor has reserved the time;

  • the tutor may have prepared for the session; and

  • it may not be reasonably possible to offer the appointment to another student at short notice.

7.3 No-shows

If a student does not attend a scheduled session without sufficient notice, the full session fee may be payable.

For online tutoring, a student who fails to join the agreed session within a reasonable period may be treated as a no-show.

7.4 Exceptional circumstances

We recognise that unexpected circumstances occur.

North Shore Tutors may waive or reduce a late cancellation charge where we consider this reasonable in the circumstances.

Any waiver applies only to the relevant cancellation and does not waive the policy for future sessions.

7.5 Tutor cancellations

If a tutor cancels a session, you will not be charged for a session that does not take place.

Where appropriate, the tutor or North Shore Tutors may offer to reschedule the session.

8. Fees

The applicable tutoring rate will be communicated to you before tutoring begins or before a revised rate takes effect.

Rates may vary depending on matters including:

  • tutor;

  • year level;

  • subject;

  • tutoring format;

  • service type;

  • location; and

  • other agreed requirements.

Unless expressly stated otherwise, quoted fees apply to the duration of the scheduled tutoring session.

9. GST

Where GST is applicable, pricing and invoices will identify the applicable GST treatment.

Nothing in these Terms changes any requirement under Australian law relating to price disclosure or GST.

10. What the tutoring fee includes

Unless otherwise agreed, the tutoring fee covers:

  • delivery of the scheduled tutoring session;

  • reasonable preparation directly associated with the session;

  • selection or preparation of ordinary lesson resources; and

  • reasonable brief session administration.

The fee does not automatically include unlimited:

  • marking outside lessons;

  • assessment editing;

  • preparation of extensive personalised resources;

  • telephone calls;

  • parent meetings;

  • correspondence;

  • homework review; or

  • other work performed outside the scheduled session.

A tutor may choose to provide reasonable assistance outside a lesson without additional charge, but this does not create an ongoing entitlement to unlimited out-of-session support.

Where substantial additional work is required, any fee should be agreed before that work is undertaken.

11. Invoicing

North Shore Tutors generally invoices clients monthly for tutoring services provided during the preceding billing period.

Invoices will ordinarily itemise relevant tutoring sessions or charges.

Clients should review invoices promptly and contact us if they believe an invoice contains an error.

12. Payment

Unless otherwise stated on the invoice:

  • invoices are payable within 14 days;

  • payment must be made using an approved payment method; and

  • payments for North Shore Tutors sessions must be made to North Shore Tutors, not directly to the tutor.

North Shore Tutors may use third-party payment providers to process transactions.

We do not currently impose a separate card-processing surcharge where payment is made through our approved card-payment method, unless we clearly notify you otherwise before the payment is made.

13. Overdue accounts

If an invoice becomes overdue, we may:

  • contact you regarding payment;

  • temporarily suspend future tutoring;

  • decline to schedule additional sessions; and

  • take reasonable steps to recover amounts properly owing.

Before imposing any separate debt-recovery or administrative charge, we will ensure that the charge has been disclosed, is permitted by law and reasonably reflects the relevant cost.

We encourage clients experiencing a genuine payment issue to contact us promptly.

14. Changes to fees

We may change tutoring fees or our pricing structure.

Where a change affects an existing client's ongoing tutoring arrangements, we will provide at least one month's notice before the new rate takes effect unless:

  • the client requests a different service;

  • the client changes tutors and agrees to a different tutor rate; or

  • another change has been expressly agreed.

A new price will not retrospectively change charges for tutoring already provided.

If you do not wish to continue at the revised rate, you may stop future tutoring subject to payment of services already provided and the cancellation requirements for existing bookings.

15. Payment through North Shore Tutors

Clients must not pay tutors directly for tutoring sessions arranged through North Shore Tutors unless North Shore Tutors has expressly authorised this in writing.

This ensures that:

  • invoices are accurate;

  • payments are properly recorded;

  • relevant protections and administrative systems remain in place; and

  • tutor payments can be correctly administered.

16. Client responsibilities

Clients agree to:

  • provide accurate information about the student's requirements;

  • provide accurate contact and scheduling information;

  • notify us of relevant changes;

  • ensure tutoring locations are reasonably safe and suitable;

  • treat tutors and staff respectfully;

  • ensure students behave appropriately during sessions;

  • provide reasonable access to relevant educational materials where necessary;

  • pay valid invoices when due; and

  • communicate cancellations and scheduling changes promptly.

17. In-home tutoring

Where tutoring occurs in a private residence, the client is responsible for providing a reasonably safe and appropriate environment.

For students under 18, a parent, guardian or other responsible adult should be reasonably available during an in-home session unless another arrangement has been considered appropriate.

Tutors are not engaged to provide childcare, supervision outside the tutoring session or transportation of students unless expressly agreed.

18. Online tutoring

Online tutoring may depend on third-party technology such as Zoom, video-conferencing services, online whiteboards or learning platforms.

Clients are responsible for providing:

  • a suitable device;

  • reasonable internet access;

  • appropriate software where required; and

  • an appropriate environment for the student to participate.

We are not responsible for interruptions caused by a client's internet service, device failure or other technology outside our reasonable control.

If a substantial technical problem is caused by North Shore Tutors or the tutor, we will seek to provide a reasonable solution, such as extending or rescheduling the affected portion where appropriate.

19. Educational results

Tutoring is intended to support learning, confidence, knowledge and academic skills.

Academic outcomes depend on many factors outside our control, including:

  • student engagement;

  • attendance;

  • effort;

  • school teaching;

  • assessment conditions;

  • independent study;

  • health;

  • individual ability; and

  • examination performance.

Accordingly, North Shore Tutors and its tutors do not guarantee:

  • a particular mark;

  • an ATAR;

  • a Band 6;

  • admission to a school or university;

  • improvement by a particular amount; or

  • any other specific educational outcome.

This does not affect any consumer guarantee that applies by law to the services themselves.

20. Academic integrity

North Shore Tutors supports legitimate education and academic development.

Tutors may assist students to:

  • understand concepts;

  • plan responses;

  • improve writing;

  • interpret feedback;

  • practise questions;

  • edit their own work; and

  • develop study skills.

Tutors are not required to complete assessable work dishonestly on behalf of a student.

Clients and students remain responsible for complying with:

  • school rules;

  • assessment requirements;

  • examination requirements;

  • plagiarism requirements; and

  • applicable academic-integrity policies.

21. Educational resources

North Shore Tutors or its tutors may provide:

  • worksheets;

  • notes;

  • questions;

  • study guides;

  • templates;

  • practice examinations;

  • lesson materials; and

  • other educational resources.

Unless otherwise stated, resources supplied by North Shore Tutors are provided for the student's personal educational use.

Clients and students must not commercially:

  • reproduce;

  • resell;

  • publish;

  • upload;

  • distribute; or

  • licence

North Shore Tutors proprietary resources without permission.

Some materials may incorporate or link to third-party content and remain subject to the rights of their respective owners.

22. Intellectual property

North Shore Tutors retains its rights in its:

  • website content;

  • branding;

  • logos;

  • original educational resources;

  • internal systems;

  • training materials;

  • business documents; and

  • other original material.

Nothing in these Terms transfers ownership of North Shore Tutors intellectual property to a client or student.

23. Tutors

Tutors provide services through arrangements with North Shore Tutors.

Depending on the applicable arrangement, tutors may be employees, contractors or other authorised service providers.

Tutors are expected to comply with applicable North Shore Tutors standards, including requirements relating to:

  • professionalism;

  • conduct;

  • communication;

  • child safety;

  • privacy;

  • academic integrity; and

  • service delivery.

24. Working With Children and safety

North Shore Tutors takes child safety seriously.

Where required for their role, tutors must satisfy applicable Working With Children Check or other screening requirements.

Clients must promptly inform North Shore Tutors of serious concerns relating to:

  • tutor conduct;

  • child safety;

  • inappropriate communication;

  • boundaries; or

  • behaviour during tutoring.

Concerns may be reported to admin@northshoretutors.com.au.

Nothing in these Terms prevents any person from contacting police, a regulator or another appropriate authority where required.

25. Communication

We may communicate with clients through:

  • email;

  • telephone;

  • SMS;

  • TutorCruncher;

  • messaging platforms; or

  • other reasonable communication methods.

Service communications may include:

  • tutoring arrangements;

  • tutor information;

  • scheduling;

  • invoices;

  • reports;

  • policy changes;

  • fee changes; and

  • important service information.

Clients are responsible for maintaining current contact information.

26. Marketing communications

We may send marketing communications where we have the consent or other lawful basis required under applicable law.

Marketing communications may include information about:

  • tutoring services;

  • educational resources;

  • promotions; and

  • relevant North Shore Tutors offerings.

You may opt out of marketing communications at any time.

Opting out of marketing does not prevent us from sending necessary service communications.

27. Privacy

Personal information is handled in accordance with the North Shore Tutors Privacy Policy, as updated from time to time.

The Privacy Policy explains, among other matters, our use of:

  • TutorCruncher;

  • cloud services;

  • payment providers;

  • ChatGPT and OpenAI services;

  • Claude and Anthropic services; and

  • other technology used to operate the business.

28. Complaints and concerns

If you have a concern about:

  • a tutor;

  • a session;

  • an invoice;

  • service quality;

  • privacy; or

  • another aspect of North Shore Tutors,

please contact us as soon as reasonably possible.

We will seek to investigate and respond fairly.

29. Changing tutors

A client may request a different tutor at any time.

We will make reasonable efforts to identify an alternative tutor but cannot guarantee:

  • immediate availability;

  • the same schedule;

  • the same location;

  • the same tutoring rate; or

  • availability of a tutor with identical qualifications.

Any different fee applicable to a replacement tutor will be communicated before tutoring with that tutor begins.

30. Suspending or ending services

A client may stop future tutoring at any time, subject to:

  • paying amounts already owing; and

  • complying with the cancellation requirements for sessions already booked.

North Shore Tutors may also suspend or stop providing services where reasonably necessary, including because of:

  • serious or repeated non-payment;

  • threatening, abusive or inappropriate behaviour;

  • safety concerns;

  • repeated serious breaches of these Terms;

  • inappropriate treatment of tutors or staff;

  • unlawful conduct; or

  • circumstances where we can no longer reasonably provide the service.

Where practicable and appropriate, we will provide reasonable notice.

31. Events outside reasonable control

Neither North Shore Tutors nor a tutor will be responsible for a failure or delay caused by circumstances outside reasonable control, including:

  • serious illness;

  • emergencies;

  • natural disasters;

  • transport disruption;

  • power failures;

  • telecommunications outages;

  • government restrictions; or

  • other comparable events.

Where reasonably practicable, affected sessions will be rescheduled or otherwise addressed fairly.

32. Australian Consumer Law

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law or another applicable law.

Where a right or remedy cannot legally be excluded, these Terms operate subject to that right or remedy.

The First Lesson Guarantee and any other voluntary North Shore Tutors guarantee are additional to statutory consumer rights.

33. Liability

To the maximum extent permitted by law, North Shore Tutors is not liable for indirect or consequential loss arising solely from circumstances outside our reasonable control.

Nothing in this clause or elsewhere in these Terms:

  • excludes liability where it cannot legally be excluded;

  • limits applicable Australian Consumer Law rights; or

  • excludes liability for conduct where doing so would be unlawful.

34. Severability

If a provision of these Terms is found to be invalid, unlawful or unenforceable, that provision may be read down or severed to the extent necessary.

The remaining provisions will continue to operate.

35. Waiver

If North Shore Tutors chooses not to enforce a term on one occasion, this does not mean that the term is permanently waived.

For example, waiving a late cancellation fee once does not require us to waive future late cancellation fees.

36. Changes to these Terms

We may update these Terms where reasonably necessary because of:

  • changes to our services;

  • changes to technology;

  • changes to payment arrangements;

  • operational requirements; or

  • changes in law.

Where a material change affects existing clients, we will provide reasonable notice before the change takes effect.

Changes will not retrospectively alter fees or obligations relating to services already provided.

If you do not agree with a material change, you may discontinue future services subject to payment of valid outstanding amounts and existing cancellation obligations.

37. Entire agreement

These Terms, together with:

  • any agreed tutoring rate;

  • relevant booking information;

  • our Privacy Policy; and

  • any other written terms expressly agreed with you

form the agreement relating to the tutoring services.

If there is an inconsistency between these Terms and a specific written agreement expressly approved by North Shore Tutors for a particular service, the specific written agreement will apply to the extent of the inconsistency.

38. Governing law

These Terms are governed by the laws applicable in New South Wales, Australia.

The parties submit to the courts and tribunals having jurisdiction in New South Wales, subject to any rights available under applicable consumer law.
